Jaipur POCSO court refuses relief in rape case of minor, career in danger

Royal Challengers Bangalore (RCB) fast bowler Yash Dayal has suffered a major blow as the Protection of Children from Sexual Offenses (POCSO) court in Jaipur rejected his request for anticipatory bail in a case related to allegations of sexual assault of a minor.

The POCSO court’s decision has put Yash Dayal in serious trouble, as it found enough evidence and seriousness of allegations that the investigation can be continued without giving protection from arrest to the Indian bowler.

Why did Jaipur POCSO court reject the anticipatory bail of Yash Dayal in the rape case of a minor?

This order was given by Judge Alka Bansal of Jaipur Metropolitan Court (POCSO Court-3). In a major blow, the court said that Dayal has not been wrongly implicated in view of the material appraised by the victim.

The court further said that the investigation points towards the possible involvement of the RCB bowler, hence the judge decided not to grant him anticipatory bail.

The decision of the POCSO court has put Yash Dayal’s career in serious danger. The fast bowler was retained by RCB for the upcoming IPL 2026 and this case in Jaipur is putting his career in danger. Now, after his bail was rejected by the court, the defending champions may consider looking for his replacement.

However, Dayal’s legal team argued that he only met the girl in public places and claimed that she was playing the role of the victim. The defense also said that a similar case registered in Ghaziabad is part of an alleged extortion conspiracy, but the Jaipur court still refused to grant anticipatory bail to Yash Dayal.

Details of allegations, evidence and minor claims against RCB bowler and its impact

The ramifications of this could be huge, as Yash Dayal will not only lose his IPL contract with RCB, but also his contract with the Uttar Pradesh Cricket Association (UPCA), and if he is proven guilty, the BCCI could ban him from cricket.

Earlier this year, a minor had lodged an FIR against Dayal at Sanganer Sadar police station in Jaipur. The minor alleged that the UP bowler emotionally blackmailed her and raped her multiple times in hotels in Jaipur and Kanpur for about two and a half years.

Police have reportedly recovered chats, photos, videos, call records and hotel booking details and these items are being considered as crucial evidence under the POCSO Act.

POCSO Act and its seriousness

The POCSO Act, which was introduced in 2012, is a strict law designed to protect children under the age of 18 from sexual exploitation, abuse and harassment.

The punishment under this law depends on how serious the crime is. In the most serious cases, including aggravated penetrative sexual assault, the accused may face a minimum of 20 years in prison. In extreme cases, the accused may face life imprisonment and even the death penalty. Penetrative sexual assault carries a minimum punishment of 10 years in prison, which may extend to life imprisonment.

For serious sexual harassment, the accused can be jailed for 5 to 7 years along with fine. Sexual assault can be punishable with a prison term of 3 to 5 years, while sexual harassment can be punishable with a prison term of up to 3 years and a fine. The important thing is that POCSO cases cannot be settled or compromised by both the parties.
