Delhi High Court extends hearing of personality rights case till July 9

India national cricket team’s star batsman Abhishek Sharma has moved the Delhi High Court as he claims that his image and identity are being misused on the internet.

Abhishek Sharma, who is currently on the England tour with Team India, requested the High Court to protect his personality rights as some online content is using his name and pictures in a misleading manner. Recently, Ishan Kishan replaced Abhishek Sharma as the No. 1 T20I batsman.

According to Bar & Bench report, Abhishek Sharma’s case was heard by Justice Jyoti Singh. The court has started probing the web link mentioned in the Indian cricketer’s plea seeking protection of his personality rights on the digital world.

The Delhi High Court, during the hearing, looked at various posts and images which the left-handed batsman believes are damaging his public image.

However, the court did not pass any final order during the hearing but decided to hear the case again on July 9 as some issues in the petition still need to be clarified. Meanwhile, the Indian coach opened up about the T20 struggles under Shreyas Iyer, outlining the outlook for the 2028 World Cup.

During the hearing, Meta’s lawyer Varun Pathak told the court that eight web links are being discussed at this stage. He said that two of those links are no longer working.

He also argued that one of the remaining links resembled a typical celebrity paparazzi post and did not violate Abhishek Sharma’s personality rights.

“There are 8 URLs; 2 of them are inaccessible. One URL is paparazzi-like, but it is not within the scope of personality rights,” he said.

But Abhishek’s lawyer completely disagreed with this, because the matter was not about the paparazzi’s photo. The lawyer claimed that Abhishek was originally standing with his manager, but the image was edited using artificial intelligence and presented in a completely different way, leading to a false impression.

Abhishek’s lawyer told the court: “What is this indicating? Is it that he is crying on the shoulders of another, and this is an AI-generated image? This is not a paparazzi issue. He has clicked with the manager and then given it a different color using artificial intelligence.”

Meanwhile, hearing the arguments, the Delhi High Court said that cases related to personality rights and defamation are becoming more complex. The court said that AI-generated images and edited content are becoming common on social media, making things difficult to assess.

The Delhi High Court said, “We also find every day that there is a thin line between defamation and personality rights. It is in flux. There is a bit of overlap. There may be a personality rights element in a defamatory case. Reader: If someone says something that is untrue or offensive, that would fall into a different category. So, it would probably be defamation or privacy. What starts happening is, in many of the lawsuits, people start reporting content that is defamatory. Is.”

On which Meta’s lawyer told the court that the number of links mentioned in the case has increased unexpectedly, hence investigating such a large number of links and taking action on them is not an easy task. He also argued that Meta cannot be expected to remove every post made about a public figure simply because it is reported.

Varun Pathak said in the court, “The plaintiff approached the court for 25 URLs. They have increased to 4000 URLs. Now it has become impossible for us, because then they want to clean up anything anyone says against him on the internet.”
